1. Acceptance of Terms
By accessing or using the HandyPro platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.
HandyPro reserves the right to update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
2. Platform Description
HandyPro is a technology platform that connects clients seeking home services with independent service professionals ("Pros"). HandyPro operates as a referral agency for minor home repairs and as an information platform for licensed construction services.
- HandyPro does not perform, supervise, or guarantee any services listed on the Platform.
- HandyPro does not employ, manage, or control any service professional.
- All professionals on the Platform are independent contractors who operate their own businesses.
- HandyPro provides technology tools to facilitate connections between clients and independent professionals.
For minor home repair services (under $1,000), HandyPro acts as a referral agency. For licensed construction projects (over $1,000), HandyPro acts solely as an information platform -- similar to a directory -- and does not process payments or manage the engagement between the client and the contractor.
3. User Accounts
To use certain features of the Platform, you must create an account. You agree to:
- Provide accurate and complete registration information.
- Maintain the security and confidentiality of your account credentials.
- Accept responsibility for all activity that occurs under your account.
- Notify HandyPro immediately of any unauthorized use of your account.
4. Booking Terms
When you request a service through the Platform, you are entering into a direct agreement with the independent service professional, not with HandyPro.
- All service terms, including scope of work, scheduling, and pricing, are determined solely by the independent professional.
- HandyPro is not a party to any agreement between a client and a professional.
- Cancellation policies are set by individual professionals. HandyPro may facilitate communication but is not responsible for enforcement.
Estimates and pricing information displayed on the Platform are for informational purposes only and may differ from the final price set by the independent professional.
5. Payment Terms
For eligible minor home repair services processed through the Platform:
- The client pays the professional's rate plus a transparent Platform Fee. The Platform Fee is charged to the client, not deducted from the professional's earnings.
- All fees are clearly displayed before booking confirmation. There are no hidden charges.
- Payments are processed securely through our third-party payment processor (Stripe).
- For licensed construction projects (over $1,000), HandyPro does not process any payments. Clients pay the contractor directly.
6. Professional Independence
Service professionals listed on HandyPro are independent contractors, not employees, agents, partners, or franchisees of HandyPro. This means:
- Professionals set their own rates, schedules, and service areas. HandyPro does not dictate or recommend pricing.
- Professionals choose which jobs to accept or decline without penalty or consequence from HandyPro.
- Professionals are free to work on any competing platform or independently.
- Professionals create and manage their own profiles and service descriptions.
- Any training or certification programs offered by HandyPro are entirely voluntary and not a condition of using the Platform.
- HandyPro does not provide tools, equipment, or materials to professionals.
Clients of service professionals are clients of those professionals, not clients of HandyPro. HandyPro's role is limited to providing the technology platform that facilitates the initial connection.
7. Limitation of Liability
To the fullest extent permitted by applicable law:
- HandyPro is not responsible for the quality, safety, legality, or outcome of any services performed by independent professionals.
- HandyPro is not liable for any damages, injuries, or losses arising from services arranged through the Platform.
- HandyPro's total liability for any claims related to the Platform shall not exceed the amount of Platform Fees paid by you in the twelve (12) months preceding the claim.
HandyPro does not make any representations or warranties regarding the qualifications, background, or reliability of any service professional. Clients should independently verify the qualifications and licensing of any professional before hiring.
8. Dispute Resolution
In the event of a dispute:
- Disputes between clients and professionals regarding services should be resolved directly between those parties. HandyPro may offer mediation tools but is not obligated to resolve service-related disputes.
- Disputes with HandyPro regarding the Platform or these Terms shall be resolved through binding arbitration in Los Angeles County, California, in accordance with the rules of the American Arbitration Association.
- You agree to waive any right to a jury trial or to participate in a class action lawsuit against HandyPro.
9. Privacy
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. Please review our Privacy Policy.
10. Modifications to Terms
HandyPro may modify these Terms at any time by posting updated Terms on the Platform. We will provide notice of material changes via email or through the Platform.
Your continued use of the Platform after any modification constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Platform.
